Welcome to National Hoops Foundation Inc. ("National Hoops Foundation," "Foundation," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and participation in our website, programs, events, activities, services, and materials.

By accessing our website, registering for or participating in any Foundation program or event, or making a donation, you agree to be bound by these Terms. If you are registering or participating on behalf of a minor, you represent and warrant that you are the minor’s parent or legal guardian and accept these Terms on the minor’s behalf.

1. Mission and Nonprofit Status

National Hoops Foundation Inc. is a registered nonprofit organization recognized by the Internal Revenue Service as a 501(c)(3) public charity (EIN: 39-4126212). The Foundation is dedicated to youth development, mentorship, and community impact through basketball.

All programs, events, and fundraising activities are conducted for charitable, educational, and community-benefit purposes. Program fees, when applicable, are used to support operating costs, program delivery, and expanded access for underserved youth.

2. Eligibility and Registration

  • Participation in Foundation programs may be subject to age, skill level, health, or other eligibility requirements.

  • Registration is not complete until all required forms, waivers, consents, and payments (if applicable) are submitted and accepted.

  • The Foundation reserves the right to limit, refuse, suspend, or cancel participation based on program capacity, safety concerns, inaccurate information, or alignment with our mission and policies.

  • Parents or legal guardians registering a minor certify that all information provided is accurate and complete.

3. Fees, Scholarships, and Financial Assistance

  • Program fees are disclosed at the time of registration and may cover facility use, staffing, equipment, instruction, and program development.

  • Scholarships, sliding-scale fees, and financial assistance may be offered at the Foundation’s discretion based on availability and eligibility.

  • Refunds or credits are governed by the policies communicated during registration. Requests outside posted deadlines may be considered only in exceptional circumstances.

  • If a program is canceled by the Foundation, registered participants will receive a refund or credit as determined by the Foundation.

4. Code of Conduct

All participants, parents or guardians, volunteers, staff, and spectators are expected to:

  • Demonstrate respect, sportsmanship, and positive behavior

  • Follow all Foundation rules, staff instructions, and facility guidelines

  • Refrain from harassment, discrimination, bullying, violence, or disruptive conduct

The Foundation reserves the right to remove or suspend any individual whose conduct jeopardizes safety, disrupts programming, or violates these standards, without refund.

5. Health, Safety, and Medical Consent

  • Parents or guardians must provide accurate medical information and emergency contact details.

  • Participants agree to follow safety instructions related to training, drills, hydration, equipment use, and injury prevention.

  • The Foundation may require medical clearance before a participant resumes activity following illness or injury.

  • In the event of an emergency, the Foundation is authorized to seek medical treatment for a participant and contact emergency responders. Participants and guardians accept responsibility for any associated medical costs.

Participation in athletic activities involves inherent risks. By enrolling, you acknowledge and accept these risks.

6. Volunteer Requirements

Volunteers are essential to our mission. Volunteers may be required to:

  • Comply with Foundation policies, training requirements, and child safety protocols

  • Undergo background checks for roles involving direct or unsupervised contact with minors

  • Promptly report safety concerns or policy violations to Foundation staff

Failure to comply may result in removal from volunteer roles.

7. Intellectual Property

All content and materials provided by the Foundation, including but not limited to curricula, drills, videos, logos, graphics, and written content, are the property of National Hoops Foundation Inc. and are protected by applicable copyright and trademark laws.

You may not reproduce, distribute, modify, or use Foundation materials for commercial purposes without prior written consent. Limited personal or educational use is permitted where allowed by law.

8. Photography, Video, and Publicity

By participating in Foundation programs or events, you grant permission for the Foundation to photograph, video record, or otherwise capture participants for nonprofit promotional, educational, archival, and fundraising purposes.

Parents or guardians may request in writing that their child not be photographed or publicly identified. The Foundation will make reasonable efforts to honor such requests.

9. Privacy and Data Use

The Foundation collects personal information necessary for registration, communication, and program administration. Personal information is handled in accordance with our Privacy Policy.

We may use aggregated or de-identified data for reporting, evaluation, and nonprofit analytics. The Foundation does not sell personal information.

10. Donations, Grants, and Sponsorships

  • Donations are voluntary and support the Foundation’s charitable programs, scholarships, operations, and outreach efforts.

  • Donations are non-refundable unless otherwise required by law.

  • Donors and sponsors may be publicly acknowledged unless anonymity is requested.

11. Website Use and Accounts

If you create an account on the Foundation’s website, you agree to:

  • Provide accurate and current information

  • Maintain the confidentiality of your login credentials

  • Accept responsibility for all activity conducted through your account

The Foundation reserves the right to suspend or terminate access for misuse or violations of these Terms.

13. Disclaimer

Foundation programs, services, and website content are provided on an “AS IS” and “AS AVAILABLE” basis. The Foundation makes no warranties regarding uninterrupted access, error-free operation, or specific outcomes from participation.

14. Limitation of Liability

To the fullest extent permitted by law, National Hoops Foundation Inc. is not liable for:

  • Injuries or damages arising from participation in athletic or related activities

  • Loss or theft of personal property

  • Indirect, incidental, or consequential damages

  • Unauthorized access to personal information beyond reasonable control

15. Indemnification

You agree to indemnify and hold harmless National Hoops Foundation Inc., its directors, officers, employees, volunteers, partners, and agents from claims arising out of:

  • Your participation in Foundation programs or activities

  • Your violation of these Terms

  • Your misuse of Foundation property, facilities, or materials

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

17. Changes to These Terms

The Foundation may update these Terms at any time. Changes will be posted with an updated “Last Updated” date. Continued participation or website use constitutes acceptance of the revised Terms.
